"Restitched" — Testing Agreement and EULA

Effective Date: April 1, 2025

Thank you for participating in Restitched Testing ("Test") developed and published by Trixel Creative, LLC ("Trixel Creative", "we", "us", or "our").

By installing, accessing, or playing the Test, you ("you" or "Tester") agree to the terms of this Testing Agreement and End User License Agreement ("Agreement").

If you do not agree, do not participate in the Test.

1. License Grant

Trixel Creative grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Test solely for the purpose of testing, evaluating, and providing feedback.

2. Confidentiality

The Test, and any materials related to it (including features, content, visuals, and discussions), are confidential unless otherwise specified.

You agree:

• Not to share gameplay footage, screenshots, or information about the Test without written permission from Trixel Creative.

• Not to livestream, record, or distribute the Test or its contents unless explicitly authorized.

• Not to share, copy, or distribute any save files, builds, or extracted assets from the Test.

3. Prohibited Actions

You agree not to:

• Modify, alter, translate, adapt, or create derivative works based on the Test.

• Reverse engineer, decompile, disassemble, datamine, or otherwise attempt to extract or discover the source code, assets, or underlying structure of the Test.

• Bypass or interfere with any security or technical restrictions in the Test.

• Share or distribute any extracted materials, including but not limited to save files, textures, models, or other game assets.

4. Feedback

We value your feedback!

By participating, you agree that:

• Any feedback, ideas, suggestions, or reports you provide may be used by Trixel Creative for any purpose (including improving or developing the Game) without compensation or attribution.

• You waive any rights to the feedback you provide.

5. Ownership

Trixel Creative retains all rights, title, and interest in and to the Test, the Game, and all associated materials.
This Agreement does not grant you ownership of the Game, the Test, or any related assets.​

6. Online Features and Third-Party Services

The Test may include access to online features such as Steam Workshop integration.

Your use of these features is additionally subject to the applicable terms, rules, and policies of Valve Corporation ("Steam") or any other relevant third-party service providers.

 

This includes, without limitation, Steam’s Subscriber Agreement, Steam Workshop Guidelines, and Content Rules.

 

Trixel Creative is not responsible for the actions of third-party services or for any content you upload, share, or access through them.

7. No Warranties / Test Software

The Test is pre-release software and is provided "as is" without warranties of any kind, express or implied.
Trixel Creative does not guarantee that the Test will be free of bugs, errors, or interruptions.

8. Termination and Enforcement

Trixel Creative may terminate your access to the Test at any time, for any reason, without notice.

Additionally, if you breach this Agreement, Trixel Creative reserves the right to pursue any and all remedies available under law or equity, including seeking legal action and damages.

9. Eligibility

You must be legally able to enter into this Agreement (typically, you must be at least 13 years old or older, and have parental permission if under 18 depending on local laws).

By participating, you represent that you meet these requirements.

10. Updates and Changes

Trixel Creative may update, modify, or discontinue the Test at any time without notice.

We may also update this Agreement from time to time. Your continued participation after updates means you accept the revised terms.

11. Limitation of Liability

To the maximum extent permitted by law, Trixel Creative will not be liable for any damages, losses, or injuries arising from your participation in the Test.

12. Governing Law

This Agreement is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
